Separated but living under the same roof?

You can apply for a divorce but the Court will require an affidavit as evidence that you are separated even when you are living under the same roof. For example, that either you or your spouse have confirmed the end of the relationship, and from that time, you did not act like husband and wife.

Married for less than 2 years?

If you have been married less than 2 years, you must consider marriage counselling before applying for a divorce.

What's involved with a sole divorce application?

A Sole Divorce Application is an application that is filed solely by one spouse to be served to the other spouse, who then has the opportunity to file a response. The Family Law Act requires a couple to have been separated for a period of 12 months and must be satisfied that the marriage has irretrievably broken down.

What's involved with a joint  divorce application?

A joint divorce application is where you and your spouse agree to the preparation and filing of the joint application together. Therefore, both you and your spouse are joint applicants. If you and your spouse apply for a joint application, you won't need to attend the divorce hearing unless you choose to, and neither spouse needs to be served with the divorce application.
